Hilary Holmes Rheaume, a Shareholder in our Manchester, NH office, provided insight in recent Automotive News article, “Trump FTC Chairman OK’d Some Cases Against Dealerships, Showed Skepticism on Disparate Impact.”
With Andrew Ferguson now leading the Federal Trade Commission (FTC), the agency is expected to focus on enforcing existing laws rather than introducing sweeping new regulations.
Hilary anticipates that the FTC will remain active in policing deceptive pricing and finance practices. “The FTC under Ferguson will not engage in heavy rulemaking, but I think there will be enforcement actions,” she explains. She notes that while the level of scrutiny may shift from the aggressive oversight seen under former Chair Lina Khan, dealerships should not expect a hands-off approach. “I do think there very much will still be light on the auto industry. So, auto dealers should not be complacent at this time.”
