Shareholder Suzanne Breselor Lowell, of Bernstein Shur’s Real Estate Practice Group, was quoted in a WGME article titled, “Taxing Seasons: Arundel Cottage Owners Question Tax Assessments Amid Living Restrictions.”
As a former real estate agent who now manages complex commercial real estate transactions with substantial property tax implications, Suzanne was able to provide legal context as to why a municipality may be collecting certain taxes for a neighborhood of seasonal cottage homes:
“Property assessments are based on what we call the ‘just value,'” said Suzanne. “That takes into account all the features of a property. If you had the exact same property, with the exact same features, on very similar lots but could be used for 12 months out of the year, it would be valued higher than the one that can only be used for a portion of the year.
